Man Diagnosed with Lung Cancer Wins Lottery

Wayne Schenk was diagnosed with lung cancer in December and given one year to live has won a million dollars in the New York state lottery. The only problem is that the winnings are to be paid out over 20 years and he doesn't have time to wait.

He thought the lucky scratch off ticket would buy him good care and more time. But, New York State Lottery rules prevent Wayne's winnings from doing just that. "He said, ‘I've got one foot in the grave and one foot on a banana peel and now New York state is going to screw with me and I'm not going to get all my money,'" [his friend] Domonick recalled.

The New York State Lotto says:

“We are, and have been, ready to work with a bank or financial institution and expedite the necessary legal paperwork to allow Mr. Schenk to receive an appropriate portion of his remaining 19 annual payments. Every month, the lottery makes some of its scheduled payments to companies and financial institutions that have stepped up and helped lottery winners in their time of need.”

Schenk is receiving treatment at a VA hospital but would like to get treatment at a cancer center and says the money would help him do that.

It's tragic and a sad state of affairs that the only way many people can afford cancer treatment is to win the lottery. Let's hope he is able to access the money so that he can get the care he needs.

I first read this on AOL news. As soon as I finished I emailed every member of the senate and congress I could find for NY. This sickens me, this man served our country! He should not have to worry about the cost of treatment to begin with, but the real slap in the face is finally having a chance to obtain better treatment just to have our country rip that from him.

Our tax money can pay for illegal immigrants, for drug addicts rehab, for 8 children born to an unemployed mother, yet our tax dollars won't help someone who defended our country!
The way I see it the United States is it's own worst enemy. They really need to stop worrying about the other countries and their people and start worrying about helping our own.
I pray Mr. Schenk is able to get the treatment he deserves. I lost my father a Vietnam Vet to cancer in 1999, after he was misdiagnosed because the insurance company wouldn't pay for a second scan, since he had already had cancer and been treated.
My prays wishes and hopes go out to him and his family.

This is a life and death situation.This man should get proper medical care NOW!This is his money & the state should see to it that everything is done to save his life & work out the details later.The state holds his life & his money in their hands--cut out the red tape & do the right thing.Everything is about money,it makes me sick.New York,get your priorities straight!!!!

When I first read this I was stunned in disbelief. As the first blogger stated, this veteran should not have to fight for the best possible care, never mind having the money in reserve and still not being able to use it to save his life.

No big surprise about the U.S. or N.Y., having lived here my whole life. But at the very least the financial institutions and the hospital should get together to work out the financial details. This money is guaranteed.

These institutions spend millions of dollars on advertising - I cannot think of a better ad than to show they actually care for human beings, never mind veterans.

Is the lotto ticket transferable? There must be a philanthropist out there with a million dollars willing to buy it from him.

This is so ridiculous! And sad. I wish I had the cash, I would just pay for his treatments and let him enjoy the winnings for as long as he can! I cannot believe how much free medical care we give to those who do not deserve it, yet ignore a veteran and citizen of this country when they need it!

It would be nice for a resolution to be found to pay this man a lump sum for him to enjoy what little life he has left. But People of America, WAKE UP, WAKE UP,this country's politician do not give a S_ _ T about anyone but themselves and how many under the table deals they can manifest for themselves and friends. Illegal immigrants who makes billions for big business, and big business who pays lobbyist, to work out deals with the Washington Politicians are living in America, all working and mid-class Americans, no longer have a say in this country. Our children are sent to fight wars, give they lives for this country, the Washington Politician children enjoy life, free from fighting wars. The politicians uses their position to commit crimes, worth millions, serve a few years in prison for their actions, made to pay back a small portion of the money and receive a pension once release from prison. This poor man, best let a family member claim his winning, because if he dies within the twenty-year period, what ever is not paid will not be paid. God be with him. Wake-Up America, are we will be the next Rome. Once power of the world.

Sick, sick , sick America. If Bush was a real humanitarian, he would step up to the plate and hit the guy a home run. But alas, it is all about money to influence other politicians, not take care of our own. We live in the richest country in the world and give billions to other countries in foreign aid. How come then we can't raise half a million to save a Vets life ? Politicians in this country really suck, starting at the top. I am thinking of taking out a full page ad in the NY times and try and raise enough cash to help this poor soul live out the remainder of his life in peace. Come on America, get your stuff together. This a Veteran who put his life on the line for us. We owe him much more than he is getting. And to you lame NY lottery people, get off your damn, lazy good for nothing, civil servant butts and bend the damn rules to save this mans life. If red tape and lame rules are all thats in the way, MOVE IT, MOVE IT and make it happen. I am very proud to be an American, but not so proud of our lame government. If Hillary was in charge this would be a no brainer.

Here we fly people over here, and give them treatment, people from other countries, this man hits a lottery, and has cancer, and is a Vet!! This is insane. Of course every one is forgetting that when the gentleman passes away the state will not pay out the rest of his winnings. They will not put it into trust for anyone else, nor does his next of kin inherit the money. The remainder of the funds goes back to the state, so the state wins most of the time anyway. always if it is someone that is elderly or terminally ill. Makes me want to get a bigger pair of scissors for all the red tape used to help the rich get richer, and keep the poor man poor.

I don't think treatment should cost as much as it does. It's a crying shame that something can't be done to get help. Even for those of us with insurance, it should not cost as much as it does to go to the Dr. or the hospital.

It just goues to show that if you are an this country without documentation you can get treated for FREE.

There are people out there who can and will buy the ticket from him at a discount and give him the cash. He needs to find one of them. Maybe someone like Donald Trump would do it for free, he would love the publicity.

This is so unbelievable that a veteran cannot catch a break here but...illegal aliens, women on welfare, etc can all get free health care and food stamps while I work my tail off and dont have half of what they have. Like the other person said, we even fly people from other countries here and give them free surgeries. What is wrong with this country?? I am very saddened to hear about Mr Schenk's cancer. My father died from lung cancer at the age of 58. I am also very much disappointed in our government that an ex-marine that surved for our country is not being taken care of. THE ALMIGHT DOLLAR rules again. The root of all evil, that steals the compassion from people and makes them only concerned for themselves or there company's bottom line. This is exactly why I raise my children to not sign up for the military. After you serve your time and put your life on the line for our rights & freedom the United States of America doesnt take care of them when they come home.

I am glad for Mr. Schenk's winning but he should not have to be worring about winning the lottery to pay for the best cancer treatment he can get. He is a veteran, that has surved our country to protect us and we should be protecting him now.

What a crime we as a country are commiting by not helping someone who defends our lives and our security. Why should this man or any vetern have to pay for a service to save his/her life. My brother in law died from Lung Cancer and he was a vet. The only thing they did for him was drain his lungs and let him die. My brother is a vet. and the VA is doing nothing for him. Our congress should take care of their people first and not worry about other nations. Screw the companies that will give you 1/4 of your winnings while they collect 3/4. And why should he have to get a loan. No one is going to give him a loan if he only has 12-18 months to live. WOULD YOU!!! Be real! We need to take care of OUR people.

This cancer victim should take his first payment and come out to the West Coast and see the VA physicians here for his cancer treatments since he is already receiving treatment from the VA. On the San Francisco Peninsula the VA Hospital is staffed with physicians from Stanford Medical Center. They are outstanding doctors and provide some of the best medical care in the world. Since he is a veteran and receiving his care through the VA, it is also FREE and he can keep his lottery money. All he needs to pay for is travel to and from the area. There is also another excellent VA facility in Portland, Oregon that is connected to the teaching hospital there and also provides excellent care, and is noted for its cancer treatment program for the veterans. He can get his treatments and keep his money; he would have the last laugh, recovering and living to collect all the payments.

Seems everybody posting a comment agrees just what a bummer this is.....My idea??? Instead of "The Lottery" this ..or "The State" that... or "The government" whatever, how about the NAMES of the people who won't help. There has to be one or two people that could change things if they had to answer to the people directly.

Isn't it sad that only someone with money can get the help they desperately need in this country? What is wrong with this picture??? We need universal health care, and we need it now! The fact that this poor man is a veteran and can't get the help he needs, even after legitimately winning a million dollars, is just incredible. Yes, indeed, get the names of the responsible people at the lottery who refuse to get the money to this dying veteran. Not only that, but let's all get the politicians to quit backing the health insurance industry and the drug companies - there should NOT be suffering or death of ANY individual in this country because of lack of money. Life is life, and EVERY life is valuable regardless of socio-economic status. If we have the technology or medicine to save a life, we should use it!

you have to be from another country to get help here. we dont take care of our own. but just let our government hear about someone sick from another country and we will go and get them and pay for it all and give them ssi for the rest of their lives, and make the citizens.

this man has a payment stream of $50K/year with a value of $1m. There are loads of investors who are happy to pay him up to 75% of that in cash in return for his payment streams. JG Wentworth is one such company but their buyouts are very low because of their high advertising costs. My advice to this man is to sell the income streams!

I don't know about any other states, but here in Iowa there is a commercial on T.v. about J.G.Wentworth.
They work with people who need their money now and can't wait. The ad goes to talk about structured settlements and also lottery winnings. It's worth looking into at least. The Lottery commission should look into a Lump sum. This man has stood proud for his country. It is about time that this should be recognized. Think about it, Lottery commission, if you work well with others, maybe there would be more people playing. Let this man have his earnings in a lump sum. HE DESERVES IT.

This is just another way for the rich to collect some more money, even if it is from a dying person.
If they pay him in a lump sum then they can only collect one time on the taxes, where if they pay out over say 20 years they can collect 20 times the taxes because the taxes are always changing they will get more that way.

I hate to sound like a smart butt however, why does'nt Ms Clinton, Mr. Obama, or any of the other political publicity hound Presidential hopefuls who have millions and millions of dollars in their "war chests" give this man a little cash forward and they can simply add the million dollar ticket to their portfolio! Most everyone is correct. Our government is so full of crap. Our insurance system is a money making machine for the insurance company. Mr Schenk needs to check out other countries. They wanted 33 to 36,000 dollars to do major dental work here in America for me. MY insurance would only pay 2000. per person per year. So I went to India and had it all done for 9950. Hey...bottom line, the guy is greedy! Any state that does pay out in a lump sum pays just over half the total. The twenty years payout is covered by investing the money and paying out the interest along with the lump sum over a twenty year period. That is why an insurance company will buy the ticket and only pay about half! He wants more than the ordinary citizen who might have won! and I suspect he already understands this.

The hospital REQUIRES the money up front, for this coverage, BUT if he were an illegal alien and walked in there for treatment, they could not and would not deny him. I guess there's no money left for US citizens after we take care of the health needs of the illegals.

It's typical NY State. Maybe Mrs Clinton can pull a few strings for somebody other than fellow cronies of the DNC. I don't play the lottery for that reason. First of all the pay-off is usually 1/2 the odds of winning. Then you're taxed to death on the half you receive. So you roughly get 25% of the chance you took.
I'll go to a Casino, thank you. I feel bad for the guy but I'm sure he knew the condition of the payoff. Now if he owes 400k in medical bills they will grab all his money till the debt is paid off. If he has kids give them the ticket this way he is not libel for med bills and his children can collect on the terms specified in winnig that prize.

He didn't win $1,000,000, he won $50,000 paid over twenty years -- the two thiings are not the same and anyone who has ever had a mortgage or a car loan knows this. There are companies that will buy his ticket and give him the "present value" of his annuity if that is what he wants or needs. Finally, with respect to half of the winnings going to pay taxes -- what did he expect? No special treatment is needed or warranted here.

I am a veteren also and there are several solutions to his problem. 1) There are companies that will pay him a cash percentage of his winnings if he assigns the proceeds to them. 2)If he is a retired veteren he may access the veteren goverenment health program called" TRICARE FOR LIFE" or there is a good possibility the cancer is service related and the government will cover all his medical bills plus income based on his base pay pay.
Whatever the situation may he recover swiftly. Our veterens are the best part of America and Marines are especially deserving.

Part of the problem is the outrageous cost of medical care he is being charged.... they could always reduce their fees.

For the love of Pete! He can get a loan, using the entire winnings as collateral via his estate. People who blame others for their problems and expect others to fix them are seldom successful. Grow up, go to the bank, and make a deal that's good for what you need to do!

He should consult a good tax accountant-with such a huge deduction for medical expenses, there would probably be little income tax to pay upon the sale of the annuity-certainly nowhere near 1/2.

Why not have the federal or state government give someone with some resources some enticement to help this man? Like Bill Gates or Donald Trump? How about some sort of a tax credit for either Mr. Gates or Mr. Trump and some sort of financial guarantee regarding all concerned with the lottery? The rules are the rules are the rules...but the same people who make the rules also should be able to have the same thought processes to enable judgement calls to put the value of life ahead of the value of red tape and legal processes.

If the gentlemen took the $467,000 it would be income in the year taken, but if he paid the hospital the $125,000 and $ 250,000, these amounts would be deductible medical expenses on his form 1040 and would reduce the taxable income amount the income from which the tax is calculated. Assuming the lotteru withhold 30% of the payout as required by Federal law for income taxes, he would have the balance of his taxes owed. Good luck.

As long as he is not tryoing to be selfish, or just another fifteen minutes on the news circuit, why not simply contact a law office to secure a loan for the amount of the winnings upfront, pay for the treatment, and pray. There are several ads for anuity settlement las offices everyday. I would think if it means that much for the treatment, it would be worth the whole million.

I am a sclc (small cell lung cancer) SURVIVOR! I will be 4 years this coming July! I think this man needs to get his treatment that he needs, and IF the Lottery wont step up to the plate, (since time is so critical), then someone else needs to step in like our government, IF they do not or will not which will probably be the case, then I believe someone needs TO! Such as OPRAH, DR PHIL, DONALD TRUMP, or anyone else who could help this poor man. There must be someone out there with some compassion!??

I think whoever wrote the story on this gentleman needs to held accountable for the slant that slammed the VA for the type of care it delivers. Not only is this person not knowledgeable about the system, his use of language to refer to Mr. Schenck as a "marine veteran" is another indicator that the writer was basing the article on sentiment not fact. Biased news at best. Over the last 5 years the VA has become the envy of the healthcare industry for the quality of healthcare it delivers for the cost. Over 60% of board certified physicians have received all or part of their training within the VA healthcare system and the VA is THE largest research entity in the country. There is more access for care through the VA than there is for the non-veteran with healthcare insurance. So slow and behind the times it ain't. Like any motivated healthcare consumer, one has to be bothered to research their healthcare options when healthy in order to efficiently access it when ill. Kathy made an excellent blog when she suggested that Mr. Schenck get referred to the West Coast VA that is affiliated with Stanford. It does sound like all he's looking for is a second opinion and as a former marine and veteran he is entitled to care at any of the 125 healthcare facilities nationwide that serve 6 million veterans. He would be far better to take the money and make sure that he lives comfortably for the rest of his life (I hope he will get a lump sum from the state) rather than waste it on private healthcare physicians who will probably do no different than the VA.

There are investors who would buy his rights to the money at a substantial discount if the lottery would permit that action.

My sister had the same experience.

She won $3.3 million in the Florida lottery but discovered it late and had to accept it in payments over 30 years. Two years later she was diagnosed with lung cancer and died within seven months.

She took comfort in being able to provide for her children. Perhaps he can do the same.

I just got off the phone with Roswell Park Alliance.I was told that they will meet on behalf of Mr.Schenk & do all they can to help him.He is a New York State resident & will not be denied care.I agree that we all get together & donate,so he can live & enjoy a long happy life

Mr. Schenk can obtain a loan from a financial institution I beleive, against the winnings that he is to receive over the 20 years. So in this respect, he has a venue to get the money he needs to pay for the treatment he desires. So he can still be a winner all the way around!

Regarding this person who won the lottery,
I am with a nutraceutical company hq in Montreal, that has a powerful product for cancer cells.

I HAVE BEEN GETTING TREATMENT FOR BREAST CANCER FOR TWO YEARS NOW AT THE VA HOSPITAL IN DETROIT. THEY ARE THE BEST. I HAVE HAD THE LASTEST TREATMENT AND FAST CARE. MAYBE HE NEEDS TO MOVE. I ALSO THOUGHT MY CARE MIGHT BE LESS THAN GREAT BUT I HAVE BEEN PLEASANTLY SURPRIZED.

Isn't it always the poor or middle class who are the first to want to help someone in need? If a donation sight can be set up for this man, I will give what I can. God knows that the government cannot be trusted and the wealthy do not give a damn.

Rules, rules, rules, contracts, and order or disorder. I am so sorry for this gentleman -- I wonder if there is someone he can leave the yearly payments to so that person can pay for his treatments? Or for whatever he wants, it doesnt matter, just so he gets a chance to use it. As a three time cancer patient myself I can say its so important to live your life exactly the way you want and fight for your life.. in all ways!!! There is a lot of truth in the attitude of the state and Federal governments in this matter, but someone should remember that the people who provide his treatment are not concerned. The price of the treatment is beyond exorbitant it is outrageous. It is obvious that the medical community has no intention of following the tenets of the Hippocratic Oath. We don't want or need the government to provide our medical care, but there must be a reasonable way to control the prices charged. I am tired of hearing that the reason for the high cost is the "free" care that is provided to illegal aliens, uninsured and indigent citizens. Our salaries haven't escalated at anywhere near the price for medical care has been inflated.

Let's see what is done about this! Write your senators and congressmen New Yorkers! It's campaign time, they want to keep us happy..so, use THAT to try and save this man's life! Let's watch how fast they move if we threaten not to vote for them if nothing is done!

Mr.Schenk won $50,000 per year for 20 years, which when paid out equal the $1,000,000. It's NOT a $1,000,000 lump sum that he won. If this lottery were to be paid out by the lottery (if they really had the cash flow to do so) that $50k per year for 20 years only has a PRESENT VALUE for a lump sum pay out of about $650,000 assuming a 5% annual rate of return or a PV of about $765,000 at a 3% return. So, depending on Mr. Schenk’s negotiating skills, he should be able to get more the $500k for his ticket. And as was earlier pointed out, the tax implications are not as great as taking 50% due to the medical expenses he’s likely to have. Therefore, I would argue that this was a very timely blessing that will indeed meet his needs for the treatment costs he wants. He’s certainly better off now than before!

the sad thing here is that this veteran should be getting the treatment he needs. I would think our government could buy his ticket from him for an amount that after taxes would cover the cost of his treatment. Seems Perfectly LOGICAL to me. As a tax payer this is a use of our tax dollars i can get behind. The bonus is over 20 years the governmet would get all their money back with interest.

This man is a veteran and, as one, entitled to Free medical care! VA Medical centers provide up to date first quality care, however, like all "socialized medicine" (gov't provided) it IS slow. This man can receive care & treatment at VA, he prefers private care.

The problem is the rules. ALL states should be required to pay out the winnings in a lump sum. You win it, you get it, you pay the taxes on it, then you spend or invest the balance.

Mr Jones.#22..don't you get it...the man is a veteran with a terminal illness? He obviously doesn't have the kind of job that any bank would give any amount of money to. Don't you think he might have thought about that already. Why don't you use your obvious brilliance to come up with a less idiotic response.

He needs to get with some of these companies, I know of one in KC, MO, that buys up annuities and annual payment agreements and gives the people their money now. They advertise on TV. Get a LAWYER first then look into the possiblities.

Hospitals are not in the business receiving payments over long periods of time, like 20 years and don't really have the resources to do such a thing. However, there ARE foundations associated with hospitals that can work out such deal and maybe even provide some tax relief. Though, typically such foundations with their trust arrangements are designed to take in charitable contributions which can provide tax and income advantages to the contributor.

Isn't one of our most fundamental rights "life, liberty and the pursuit of happiness"? That is a constitutional law. So, taking that thought a few steps further, aren't those who are denying this brave man his fundamental right to LIFE and the PURSUIT of happiness, breaking the law? You can't very well pursue something if you are DEAD!! But, then again, the law is only for the law makers and those rich enough to afford it. Do you think any of the recent young scarlet starlet's will see an hour of prison time for killing people with their cars? NO!!

Another tragic story I admit. As a vet he should have full coverage anywhere in the US. I agree with Nadine #67. As a retired military man, and retired Civil Servant in the Military Healthcare System, I agree that the VA of today has little resemblance to the VA of the Vietnam War era. I sympathize with the Marine. But I can't help but wonder whether there is more to the story then is being reported. If the lung cancer is service connected, like Ageant Orange or other recognized deseases contracted while in the line of duty, the VA is obligated to provide him the cancer treatment he needs. If they can not provide it inhouse, they should accomodate him at a private institution. As for the writer of the story, it should have been reported that there is a congressional mandate for the VA to partner with private and or Active Duty Medical facilities in order that they provide state-of-the-art treatment to our veterans. This effort is being carried out at locations throughout the contry. The Active Duty medical treatment personnel and VA personnel are committed to providing excelent treatment to our warriors.

It is realy sad to see how the goverment does not care for our man and women in the military. The President is willing to send the military to War but unable to help the people afterward. The military is more benefiting the rich people more than the poor, and of course the poor has nothing to loose, but yet the rich don't care as long they are still making money they could be careless. anyway instead of talking about the matter and getting mad, we should help our fellow american, by having a fund raising online for him so we can save his life. It's amazing that something like this can happen in this country. Someone needs to step up and make things happen for this guy.

My husband was diagnosed with brain and lung cancer in June and given a few months to live. It is sad but certain... the money does not buy the health, only help to obtain it by a period of time... The periodic reviews would help us to prevent the lung cancer.
